Terms of Use — Argus Player

1. Agreement

These Terms of Use ("Terms") govern the Argus Player iPhone and iPad application, the Argus Player website, and optional Argus account services (together, the "Service"). The provider and contracting party is Hello Darkness LLC, Texas, United States.

By accepting these Terms, creating an optional account, pairing a device, or using the Service, you agree to these Terms, the Privacy Policy, and the Acceptable Use Policy. If you do not agree, do not use the Service.

You must be legally able to enter into this agreement in your jurisdiction. If you use the Service for an organization, you confirm that you have authority to bind that organization.

2. What Argus Player Is

Argus Player is media-player software for sources that you supply. The App supports source details such as Xtream Codes, M3U, and STB.

Argus Player does not provide, sell, host, index, bundle, or grant access to channels, playlists, movies, series, media subscriptions, or source credentials. The built-in interface preview contains no playable media. Argus Player is not affiliated with or endorsed by any source provider, broadcaster, platform, or rights holder unless expressly stated.

Manual source entry remains available without an Argus account. An optional Argus account provides convenience features such as pairing and account-managed source synchronization.

3. Your Sources and Responsibilities

You are solely responsible for every source and item of content you add, access, stream, cast, or download. You confirm that:

Argus does not verify or endorse user-supplied sources. Questions about a source's legality, billing, availability, or content must be directed to that source provider.

4. Accounts and Device Pairing

An Argus account is optional for manual sources. If you create one, you must provide accurate information, keep your password confidential, and promptly report suspected unauthorized use through Argus Support.

Device pairing uses a short-lived temporary key and requires confirmation in your signed-in account. An Argus-generated Device ID identifies an app installation for pairing, support, and licensing; it is not a hardware MAC address, advertising identifier, password, or bearer credential.

You may review sessions, remove paired devices, export account data, and initiate permanent account deletion. Account deletion revokes sessions and paired-device access and cryptographically removes saved source secrets, subject to limited records that must be retained for security, fraud prevention, disputes, or legal obligations.

5. Playback, Casting, Downloads, EPG, and Subtitles

Playback quality and availability depend on your device, network, source, receiver, and media format. Not every stream, subtitle, receiver, or format will be compatible.

AirPlay and Chromecast operate through Apple, Google, the receiver, and your source provider. Casting may disclose the selected stream URL and limited media details to the receiver you choose.

Downloads are for lawful personal offline viewing only where your provider, the rights holder, and applicable law allow them. Argus does not remove DRM or other protections. Downloaded files remain in the App's local sandbox and may be lost when the App or download is deleted.

External EPG data comes from the URL or source you configure. Subtitle results are supplied through third-party services, including OpenSubtitles. Argus does not create, verify, moderate, or guarantee third-party guide data or subtitle files.

6. Premium Welcome Period, Free Use, and Purchases

Eligible users receive a 30-day Premium welcome period. It does not automatically convert into a paid purchase. When it ends, core Live TV, Movies, and Series playback remains available in Argus Free. Premium-only features may become unavailable, and eligible non-playback screens may show a restrained first-party Argus banner.

Paid digital features are offered only through Apple's in-app purchase system in the iOS App. Available options may include an annual auto-renewable subscription and a lifetime non-consumable purchase. The product, localized price, billing period, renewal terms, and any eligibility information displayed by the App Store at purchase time control.

Annual subscriptions renew through the App Store unless cancelled according to Apple's subscription terms. You can manage or cancel them in your Apple Account settings. Use Restore Purchases in the App to ask Apple to restore eligible purchases associated with your Apple Account. Purchase verification, billing, taxes, refunds, and Family Sharing eligibility are governed by Apple. Argus cannot issue an App Store refund directly.

No website payment, activation code, reseller code, or device serial substitutes for StoreKit in the public iOS App.

7. Privacy and Security

The Privacy Policy explains what data is handled, why it is used, where it goes, how long it is kept, and your choices. You must not submit passwords, source credentials, payment details, or other secrets through support or feature-request forms.

No service is completely secure. You are responsible for protecting your device, Apple Account, Argus account, and source credentials.

8. Acceptable Use

The Acceptable Use Policy is incorporated into these Terms. You may not misuse pairing, accounts, support, copyright reporting, network access, or the Service; introduce malicious content; interfere with operation; scrape or reverse-engineer the Service where prohibited by law; impersonate others; or violate third-party rights.

Argus may investigate suspected misuse and may proportionately restrict account services, revoke devices, remove account-managed source records, preserve required evidence, or terminate accounts. Manual device-local sources remain subject to these Terms and applicable law.

9. Intellectual Property and App License

Argus Player's software, visual design, trademarks, and documentation are owned by Argus or its licensors and are protected by law. Subject to these Terms, you receive a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded products that you own or control as permitted by the App Store Usage Rules.

You retain your rights in information you submit. You grant only the limited rights necessary to process that information and operate features you request.

Open-source and third-party components remain subject to their own licenses and notices. Apple's Standard Licensed Application End User License Agreement also applies where required: Apple Standard EULA.

10. Third-Party Services

Apple, Google Cast, OpenSubtitles, your source provider, EPG providers, receivers, hosting providers, and email providers operate independently and may apply their own terms and privacy policies. Argus is not responsible for their content, conduct, availability, security, billing, or decisions.

11. Availability, Changes, and Termination

The Service may change, experience interruptions, or discontinue a feature for security, legal, compatibility, maintenance, or product reasons. Material changes will be communicated where required. You may stop using the Service at any time and may delete an optional account from the App or website.

Argus may suspend or terminate account services for a material breach, unlawful use, security threat, repeated validated infringement, or legal obligation. Where practical and lawful, notice and an opportunity to remedy will be provided.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ARGUS DOES NOT WARRANT THAT A USER-SUPPLIED SOURCE IS LAWFUL, SAFE, COMPATIBLE, AVAILABLE, ACCURATE, OR UNINTERRUPTED.

Nothing in these Terms excludes warranties or remedies that cannot lawfully be excluded.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARGUS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, CONTENT, REVENUE, PROFITS, OR GOODWILL, ARISING FROM THE SERVICE OR A THIRD-PARTY SOURCE.

Where liability cannot be excluded, total aggregate liability related to the Service will not exceed the greater of the amount you paid for Argus during the 12 months before the claim or US $100. Some jurisdictions do not allow certain limitations, so those limitations may not apply to you.

14. Governing Law

These Terms are governed by Texas law, excluding conflict-of-law rules, except where mandatory consumer-protection law in your location requires otherwise. Courts located in Texas have jurisdiction unless applicable law permits you to bring a claim in your home jurisdiction.

15. Changes to These Terms

Argus may update these Terms. Material changes may require renewed acceptance before affected features are used. The current version is available in Settings and at argusplayer.com/legal/terms.
